CONSUMER GUARANTEES

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. These are called “Consumer Guarantees” and cannot be excluded.  Consumer Guarantees under the Australian Consumer Law are not limited by a defined time period and can vary from product to product depending on factors such as the nature of goods, price and statements made on packaging and product labels.

If you have a Product with a major problem (for example, it is unsafe, is significantly different from the sample or description), then you are entitled to a refund or replacement if the problem is a major problem.  If it is a minor problem, then we can offer you a free repair within a reasonable time. 

Where an item is damaged through misuse, neglect or abnormal use, we will not provide a refund, exchange or repair.

MANUFACTURER WARRANTY

Black Diamond warrants to the original end-user purchaser that its Black Diamond® products (“Products”) will be free from material or manufacturer defects for the Warranty Periods outlined below.

Because Black Diamond cannot control the quality of products sold by unauthorized sellers, this limited warranty applies only to Products that were purchased from Black Diamond or an authorised seller in Australia.  Unless otherwise prohibited by law, Black Diamond reserves the right to reject warranty claims from purchasers for Products purchased from unauthorised sellers, including unauthorised internet sites.  This limited warranty does not cover any defects due to normal wear and tear, damage due to misuse or excessive use, accidental damage, alteration or modifications to the Product, or neglect, negligence, or improper care.

This limited warranty does not cover:

  • Fading colours, logos, and markings due to use
  • Cuts, burns, abrasions, or tears
  • Packed out insulation
  • Poor or incorrect fit
  • Items bought used
  • Product that has been modified or altered by a person or an entity
  • Apparel that has been altered, tailored, or otherwise modified
  • Loss of waterproof coatings or treatments
  • Dulling of points (such as on crampons or ice axes)

HOW TO MAKE A WARRANTY CLAIM

Product purchased from this website

If you purchased your Black Diamond product from this website, please follow the steps below:

  1. Please complete and submit the Warranty Claim Request Form before returning the Product to us.
  2. Ensure that you provide your original proof of purchase.  Claims that are not submitted with the original proof of purchase may not be covered by the product warranty unless we are required to do so under the Australian Consumer Law.
  3. If we request that you send us your Product (at your own cost) for assessment, please ensure that the Warranty Claim Request Form is completed first.
  4. All goods returned for assessment under our Warranty Policy must be clean and dry.
  5. If required under the Australian Consumer Law, we will refund you the cost of the postage to you provided that you submit a receipt for that postage cost.

Product purchased from a Black Diamond stockist (in store or online)

If you purchased your Black Diamond product from one of our stockists, please contact this stockist in the first instance. As an authorised Black Diamond reseller, they should have the technical knowledge and general experience to assist you with your warranty claim.

WARRANTY PROCESSING TIME

We may need to assess your product to determine whether a repair, replacement or refund is appropriate.  We are not liable for any returned item that is lost in transit. We recommend that Products be returned using a trackable method to confirm receipt of delivery. We do not refund or cover the cost of return postage on warranty claims unless obliged under the Australian Consumer Law.
